Love Uninherited? Legal challenges that same-sex partners might face under Hong Kong’s inheritance law

Many same-sex couples have built a life together over the years and already see each other as family. Yet, they cannot marry in Hong Kong, and the threshold for overseas marriage remains high. Under Hong Kong law, even in a relationship marked by mutual care and support, such love is still considered unrecognized. If one partner passes away without a will, the surviving partner often has no legal right to handle funeral arrangements or inherit any estate. Within the current legal framework, what options or protection do same-sex partners really have?
This Pride Month, Alongside and Next Chapter LGBT are joining hands with Rede Chambers and Hastings & Co. to explore the legal dilemmas and available recourse for same-sex couples who have not made a will. Participants can also learn about the legal protections offered through overseas marriages. Led by experienced barristers and solicitors, the seminar will draw from real-life cases to examine the limitations and challenges of the existing legal system. The session will conclude with an open Q&A, inviting participants to reflect together: When the law still refuses to recognize us, how can we take action to protect the ones we love?
