This AMD Chatbot (“Chatbot”) is provided by Alongside Limited (“Alongside”, “we”, “us”, or “our”) for general informational and educational purposes only.

By accessing or using this Chatbot, you represent and warrant that you are at least 18 years of age, have the legal capacity to accept these Terms & Conditions, and agree to be bound by them.

 

  1. Informational Use Only
    The Chatbot is intended to provide general information about Advance Medical Directives (“AMD”) and related topics. It is not intended to provide advice tailored to your personal circumstances.
  1. Not Medical Advice
    The Chatbot is not a substitute for medical advice, diagnosis, or treatment, and must not be relied upon as such. Nothing provided through the Chatbot is intended to serve as medical advice.
    If you have any medical condition, symptoms, concerns, or questions regarding your health, treatment options, mental capacity, prognosis, or suitability for signing an AMD, you should consult a qualified medical doctor promptly.
  1. Not Legal Advice
    The Chatbot is not a substitute for legal advice and must not be relied upon as such. Nothing provided through the Chatbot is intended to serve as legal advice.
    If you require advice on your legal rights, the legal effect and implications of an AMD, validity requirements, or any other legal matter, you should consult a qualified lawyer.

 

  1. No Professional Relationship
    Your use of the Chatbot does not create any doctor-patient, lawyer-client, fiduciary, advisory, or other professional relationship between you and Alongside or any of our personnel, partners, or representatives.
  1. Accuracy and Completeness
    While we aim to make the Chatbot helpful and up to date, we cannot guarantee that all the AI-generated content is accurate, complete, updated or appropriate for your particular circumstances. You should independently verify any information before relying on it or taking action. This is especially important for medical, legal, and end-of-life planning decisions. AI-generated outputs are not meant to, and should not replace important human judgment and professional advice. 
  1. No Emergency Use
    The Chatbot is not an emergency service and must not be used in any emergency or urgent situation.
    If you or another person is in immediate danger, experiencing a medical emergency, or at risk of serious harm, please contact emergency services or seek immediate assistance from an appropriate medical professional or emergency provider.
  1. User Responsibility
    You are solely responsible for how you use the Chatbot and any decisions, actions, or omissions arising from your use of it. You must not rely on the Chatbot as the sole basis for making medical, legal, or other significant personal decisions.
  1. Acceptable Use
    You agree not to:
    (a) use the Chatbot for any unlawful, harmful, abusive, threatening, violent, fraudulent, or otherwise improper purpose, including seeking assistance for self-harm, harm to others, criminal conduct, unlawful acts, or conduct that may endanger public safety or national security;
    (b) input confidential information of another person without proper authority;
    (c) misuse, interfere with, disrupt, or attempt to gain unauthorized access to the Chatbot or related systems; or
    (d) use the Chatbot in a way that infringes the rights of any person.

 

  1. Availability of Service
    We may modify, suspend, restrict, or discontinue the Chatbot, in whole or in part, at any time and without prior notice. We do not guarantee that the Chatbot will be available at all times or free from interruption, delay, error, omission, malware, or technical malfunction.

 

  1. No Warranty
    To the fullest extent permitted by law, the Chatbot is provided on an “as is” and “as available” basis, without any representation, warranty, or guarantee of any kind, whether express or implied, including as to accuracy, completeness, reliability, fitness for purpose, availability, or non-infringement. 
  1. Limitation of Liability
    To the fullest extent permitted by law, Alongside and its directors, officers, employees, agents, collaborators, contractors, and partners shall not be liable for any loss, damage, cost, or liability of any kind arising out of or in connection with your access to, use of, inability to use, or reliance on the Chatbot or any content generated by it, including any direct, indirect, incidental, consequential, special, punitive, or economic loss, loss of opportunity, loss of data, loss of goodwill, or loss arising from delay, interruption, error, omission, or system unavailability.
    Nothing in these Terms & Conditions excludes or limits any liability which cannot lawfully be excluded or limited under applicable law.
  1. Privacy
    The Chatbot is intended for general informational use only. Alongside does not request or require, and users must not provide, any personal data, confidential information, or sensitive information through the Chatbot.
    Personal data should only be provided if and when Alongside expressly requests limited information through a separate designated process for appointment arrangement, follow-up, or relevant service provision.

  2. Alongside’s Use of Chat History
    You acknowledge and agree that chat history, prompts, submissions, responses, and other records generated through your use of the Chatbot may be collected, used, stored, reviewed, analysed, and otherwise processed by Alongside, its service providers, and/or its advisers for administration, record-keeping, quality assurance, training, audit, safeguarding, system maintenance, improvement or enhancement of the Chatbot, service improvement, analytics, research, testing, product and service development, statistical analysis, risk management, compliance, and other directly related purposes.
    Alongside also reserves the right to disclose chat history and related records to law enforcement agencies or other government authorities where required or permitted by law.

  3. Use of Chatbot Output
    Any content or output generated by the Chatbot is provided to you solely for general informational purposes. You must not use or rely on such content or output for any other purpose, including any legal, medical, regulatory, professional, commercial, or other unauthorized purpose.

  4. Changes to These Terms
    We may amend these Terms & Conditions from time to time by posting an updated version. Your continued use of the Chatbot after any update constitutes your acceptance of the revised Terms & Conditions.

 

  1. Governing Law and Jurisdiction
    These Terms & Conditions are governed by and construed in accordance with the laws of Hong Kong.
    Subject to any applicable law, the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms & Conditions or your use of the Chatbot.
